Terms of Service
The agreement between you and Visiting Niagara Falls: what we are responsible for, what the operator is responsible for, and exactly what our guarantees cover. Written in plain English, because terms nobody reads protect nobody.
Who we are
Visiting Niagara Falls ("we", "us", "our") is an online travel agency for a single destination. We list and sell tours, attraction tickets and passes at Niagara Falls on both the New York and Ontario sides of the border, from the licensed operators who run them.
These terms apply to your use of visitingniagarafalls.com and to any booking you make through it. By using the site you accept them. If you do not accept them, please do not use the site.
They sit alongside our Privacy Policy, which explains what we do with your information, our Cookie Policy, which covers what is stored in your browser, and our Accessibility Statement, which sets out how the site performs for people using assistive technology.
The short version
We are the agent, not the operator. We sell you the experience; another company runs it. Both of us owe you something, and this page is where we say which is which.
- We are responsible for describing each experience accurately, for the price you are quoted, and for standing between you and the operator when something goes wrong.
- The operator is responsible for actually delivering the experience — the boat, the coach, the helicopter, the guide, and the safety of all of it.
- You pay the operator's own price. Our commission is already inside it. Booking here does not cost more than booking direct.
- Most bookings cancel free up to 24 hours before. The exact policy is on the listing and it is the operator's, not ours.
- If your day goes wrong, contact us first. We hold the booking relationship and we will chase the operator rather than leaving you to it.
Our role: agent, not operator
We act as a booking agent for the companies that own and run these experiences. They hold the licences, the vessels, the aircraft, the vehicles and the insurance. We do not own or operate any tour, boat, helicopter or attraction, and we do not employ the guides or crew.
When you book, a contract is formed between you and the operator for the delivery of that experience, on the operator's own terms as shown on the listing and at checkout. We are a party to the booking arrangement, not to the operation of the experience itself.
That distinction matters in one direction only: it never means we walk away. If the operator lets you down, our job is to take it up with them on your behalf, and the guarantees below are our own commitments, not theirs.
Who can book
- You must be 18 or older to make a booking, and legally able to enter a contract.
- If you book for other people, you confirm you have their authority to do so and that you have passed on the details that matter — the meeting point, the timings, and any age, health, mobility or documentation requirement on the listing.
- You are responsible for the accuracy of the names, dates and contact details you provide. Some operators will not admit a traveller whose name does not match their identification.
Listings and accuracy
We write our own listings. We describe what an experience includes, how long it takes, where it starts, what it does not cover, and the physical and age requirements to take part. Live prices and availability are pulled from our booking partner when you open a page.
We work hard to keep this accurate, but operators change their own products, schedules and inclusions, sometimes at short notice. Where a listing and the operator's own confirmation disagree, the operator's confirmation is what you have bought. Photography is illustrative; vessels, vehicles, routes and viewpoints vary by departure and by season.
Obvious errors and misprints — a price that is clearly wrong, a duration that is impossible — can be corrected, and a booking made on one can be cancelled with a full refund. We will always tell you before that happens and offer you the correct price first.
If you spot something wrong on a listing, tell us. Under the Best Experience Guarantee below, a listing error that affected your booking is ours to put right.
Prices, currency and fees
What you pay
You pay the operator's own price. Our commission is paid by the operator out of that price and is already inside the figure you see, so we add no booking fee, service fee or marketplace mark-up on top.
Unless a listing says otherwise, the price excludes gratuities, meals and drinks not listed as included, personal expenses, travel insurance, parking, and any government or border fee you incur getting to the meeting point.
Currency
Prices are shown in your local currency where we can determine it. Niagara Falls straddles a border, so many operators price in a currency other than yours; in that case the figure you see is a conversion at the live exchange rate and is indicative. It is marked with a "≈" where that applies.
The amount actually charged is taken in the operator's own currency at checkout. Your bank or card issuer sets the rate it uses and may add its own foreign transaction fee, so the amount on your statement can differ slightly from the figure on the listing. That difference is between you and your card issuer, and it is not something we receive.
Price changes
Prices and availability change constantly and are not held until your booking is confirmed. A price shown on a listing is an invitation to book, not a binding offer. Once your booking is confirmed, the price of that booking will not change.
Making a booking
You do not need an account. Choose your experience, date and party, and you are handed to our booking partner's secure checkout to enter your traveller and payment details and complete the purchase.
We do not take payment on this site. Card details are entered on, and handled by, our booking partner's checkout. They never reach our servers. See the Privacy Policy for what happens to your data at that point.
Your booking is not confirmed until you receive a confirmation with a reference. Most experiences confirm instantly and issue a mobile ticket or voucher by email — no printing, no collection desk. A small number are on request and confirm within the window stated on the listing; if an on-request booking cannot be confirmed, you are not charged, or you are refunded in full.
Check your confirmation as soon as it arrives. Names, dates, times and pickup arrangements are much easier to fix on the day you book than on the day you travel.
Cancellations, changes and refunds
The policy that applies
Each experience carries its own cancellation policy, set by the operator and shown on the listing and on your confirmation. Most allow free cancellation up to 24 hours before the start time for a full refund. Some do not — tickets for fixed-date events, some helicopter and small-group departures, and certain discounted fares can be partly or entirely non-refundable. The listing says which before you book.

How to cancel or change
Use the link on your confirmation, or contact us and we will handle it. Where an operator allows date changes, we will arrange one rather than making you cancel and rebook at a new price, provided you ask inside their change window.
Timing and refunds
Cancellation windows run against the local time of the experience, not your own — an important detail when you are booking from another time zone, and one worth checking twice against a departure that starts early. Refunds go back to the card that paid, and typically take five to ten business days to appear depending on your bank.
Weather at Niagara
Boat tours, jet boats, helicopters and open-air walkways are weather-dependent, and high wind or ice can stop a departure at short notice. Operators do not run them unsafely and neither would we want them to. A weather cancellation is always refunded or rebooked. A day that is merely cold, wet or grey is not a cancellation — the falls run in every season, and the boats operate in light rain.
Our guarantees
These two are ours. They are commitments we make to you on top of whatever the operator's own terms provide, and nothing in them reduces your rights under consumer law.
Best Price Guarantee
You pay the operator's own price, never a marketplace mark-up. Find the same experience cheaper elsewhere and we will match it. To make a claim, send us a link or screenshot showing a lower price that is:
- the same experience, from the same operator, for the same date, start time and inclusions;
- for the same number and type of travellers, with the same cancellation terms;
- publicly available and bookable at the time you claim, in the same currency, with all mandatory fees and taxes included;
- claimed within 24 hours of your booking and before the experience departs.
We will verify it and refund the difference to your original payment method. The guarantee does not cover member-only, loyalty, corporate, opaque or auction pricing, cashback and points offers, bundled rates where the experience has no separately stated price, prices resulting from an obvious error, or a price shown by us in a converted currency where the underlying operator price has not changed.
Best Experience Guarantee
Every experience is one we would send a friend on. If yours does not live up to the listing, tell us and we will put it right. Concretely: if a material part of what the listing promised was not delivered — an inclusion missing, a stated duration cut short, a promised viewpoint or entry not provided — contact us within 14 days of the experience with your booking reference and what happened.
We will take it up with the operator ourselves and come back to you with a resolution: a rebooking, a partial refund proportionate to what was missed, or a full refund where the experience was fundamentally not the one you bought. We will tell you what we asked for and what the operator said.
It is a guarantee about the gap between the listing and the day, not a satisfaction guarantee. It does not cover weather, water levels or seasonal mist, other guests, traffic or border queues, a closure outside the operator's control, or a change we disclosed to you before departure.
On the day
- Arrive early. Meeting points and departure times are on your confirmation. Operators run to a schedule and cannot hold a boat or coach for a late traveller; a missed departure is treated as a no-show.
- Bring what the listing asks for. Photo identification, your mobile ticket, and anything a specific experience requires.
- Respect the requirements. Age minimums, height and weight limits, pregnancy and health restrictions, and mobility requirements exist for safety, and they are on every listing. Helicopter and jet boat operators in particular enforce weight declarations strictly. An operator may refuse participation on these grounds, and a refusal for a requirement the listing stated is not refundable.
- Follow the crew. Operators can refuse or remove anyone who is intoxicated, behaves unsafely or ignores instructions, without a refund.
- Look after your belongings. Niagara boat tours are wet by design. Bring protection for anything that must stay dry; neither we nor the operator is responsible for water damage to personal items.
Crossing the border
Niagara Falls sits on an international border. Some experiences cross it, and a booking with us is never permission to cross it.
Where an experience visits both the American and Canadian sides, or starts in one country and ends in the other, you are responsible for carrying the travel documents that entitle you to enter and re-enter — a valid passport, and any visa, ESTA or eTA your nationality requires. Requirements differ by nationality and change; check the official US Customs and Border Protection and Government of Canada guidance for your own circumstances before you book.
Border officers decide admission, not the operator and not us. Being refused entry, or being delayed long enough at a crossing to miss a departure, is treated as a no-show and is not refundable. If you are unsure whether an experience crosses the border, the listing says so — and if it is not clear, ask us before you book rather than on the morning.
Using this site
You may use the site to research and book travel for yourself and the people you are travelling with. You agree not to:
- scrape, crawl, harvest or systematically copy the listings, descriptions, prices or photography, or use them to train a model or build a competing service;
- make speculative, false or fraudulent bookings, or bookings in someone else's name without their authority;
- interfere with the site's operation, probe its security, or attempt to access anything not intended to be public;
- misrepresent yourself as us, or use our name or branding in a way that suggests an endorsement we have not given.
We may suspend access where we reasonably believe one of these is happening. The site is provided as-is and we do not promise uninterrupted availability; we take it down for maintenance from time to time.
Wishlist, trip planner and email
Your wishlist and any itinerary the trip planner generates are stored in your own browser, not in an account on our servers. Clearing your browser data clears them, and they do not follow you to another device. Keep your own copy of anything you would be sorry to lose.
The trip planner produces a suggestion based on what you tell it. It is a starting point for your own planning, not a booking, a reservation or advice — opening hours, seasonal closures and border timings all need checking against the day you actually travel.
If you subscribe to our email, you can unsubscribe from any message and we will stop. What we do with your address is in the Privacy Policy.
Intellectual property
The listings, guides, comparisons, page copy, layout, design and the "Visiting Niagara Falls" name and branding belong to us or are licensed to us, and are protected by copyright and trade mark law. Operator names, logos and product names belong to their owners and are used to identify the experiences we sell.
You are welcome to link to us, quote us with attribution, and print or save pages for your own trip. Republishing our listings or guides in bulk, or passing them off as your own, is not permitted.
Third-party content and links
Ratings and review counts shown on listings originate with the booking platform and the travellers who wrote them. They reflect those travellers' experiences, not ours, and we neither write nor edit them.
We link to operators, official park and attraction sites, transit information and government border guidance because they are useful. We do not control those sites and are not responsible for their content, their accuracy or their own terms. Following a link takes you outside this site and outside these terms.
Disclaimers
Travel information on this site — opening hours, seasonal schedules, walking distances, accessibility notes, border waits, weather patterns — is provided in good faith and researched carefully, but it is general information and not a warranty. Conditions at Niagara Falls change with the season, the water level and the day. Verify anything a plan depends on.
To the fullest extent the law allows, the site and its content are provided without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the site will be error-free or continuously available.
Nothing here excludes any liability that cannot lawfully be excluded — including liability for death or personal injury caused by negligence, for fraud, or under mandatory consumer protection law in your jurisdiction.
Limitation of liability
Because the operator runs the experience, the operator is responsible for its conduct and safety, and carries the insurance for it. We are not liable for injury, loss or damage arising from the operation of an experience, from an operator's act or omission, or from a traveller's own failure to meet a requirement the listing stated.
We are responsible for our own part: describing experiences accurately, quoting you correctly, passing your booking through properly, and honouring the guarantees above.
To the extent the law allows, we are not liable for indirect or consequential loss — missed connections, unused hotel nights, lost enjoyment or lost earnings arising from a cancelled or altered experience. Where we are found liable in connection with a booking, our total liability is limited to the amount you paid for that booking.
We strongly recommend travel insurance. It covers the things neither we nor an operator can: illness, missed flights, and the cost of a trip that does not happen.
Complaints
Contact us first, and do it early. A problem raised while you are still at Niagara Falls can often be solved that day — a rebooking onto a later departure, a word with the operator, an alternative that still saves the trip. The same problem raised a fortnight later can usually only be compensated.

- We take it up with the operator, and come back to you with their response and our own decision.
- If you are not satisfied with the outcome, say so and we will review it again ourselves before you take it further.
Governing law and disputes
These terms are governed by the laws of the State of New York, and the state and federal courts sitting in New York State have jurisdiction over any dispute arising from them.
That does not take away rights you have where you live. If you are a consumer resident in Canada, the European Union, the United Kingdom or another jurisdiction whose consumer law grants you mandatory protections or a local forum, those rights and that forum remain available to you and nothing in this section overrides them.
Your contract with the operator for the experience itself may be governed by different law — usually that of the province or state where the experience runs. That is set out in the operator's own terms.
Changes to these terms
We update this page as the business changes, and the date at the top always reflects the current version. Changes take effect when they are published and apply to bookings made after that point; a booking you have already made is governed by the terms in force when you made it. Material changes will be flagged on the site.
If any part of these terms is found unenforceable, the rest continues to apply. Our not enforcing something on one occasion does not waive it.
